1. General Terms

Welcome to Fidelity Points! These Terms and Conditions ("Terms") govern your use of the Fidelity Points website, services, and applications (collectively, the "Service"), operated by PASCOVICI SERBAN-CONSTANTIN II ("Company", "we", "us", or "our"). By accessing or using our Service, you confirm that you are in agreement with and bound by the terms of service contained in these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Fidelity Points provides a digital loyalty platform connecting local businesses with their customers.

  • For Customers: The Service offers a free digital wallet to collect and track loyalty points from various participating businesses using a unique QR code.
  • For Businesses: The Service offers a subscription-based platform to create and manage a digital loyalty program, allowing businesses to issue and redeem points for their customers.

3. Eligibility and Accounts

  • Age Requirement: You must be at least 13 years of age to use the Service. If you are under the age of 18 (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms.
  • Account Registration: You must register for an account to access the Service, which is facilitated through Google Sign-In. You are responsible for maintaining the confidentiality of your account and are fully responsible for all activities that occur under your account.
  • Account Types: You may register as either a "Customer" or a "Business". You may not hold both a Customer and Business account simultaneously with the same email address.

4. Business Subscriptions

  • Fees: Business accounts require a paid subscription to access the loyalty program features. The current fee is $9.99 per month. We reserve the right to change our subscription fees upon 30 days' notice.
  • Free Trial: We offer a one-time 30-day free trial for new Business accounts. No payment information is required to start the free trial. At the end of the trial period, you must provide valid payment information to continue using the paid features.
  • Billing: Subscriptions are billed on a monthly, recurring basis. You will be automatically charged at the beginning of each billing cycle through our third-party payment processor (Stripe).
  • Cancellation: You may cancel your subscription at any time. When you cancel, your subscription will remain active, and you will continue to have access to all paid Business features until the end of your current, pre-paid billing period. At the end of that period, your access to paid features will cease, and you will not be charged again unless you restart your subscription.
  • No Refunds: Payments are non-refundable, and there will be no refunds or credits for partially used periods. As the Service is a digital service made available for immediate use, you agree that you waive any statutory right of withdrawal or "cooling-off" period that may be applicable in your jurisdiction, to the extent permitted by law.
  • Subscription vs. Account Termination: Canceling your subscription is different from deleting your account. Canceling your subscription only stops future automatic payments but preserves your account and its data. Deleting your account is a permanent action that removes your data in accordance with our Privacy Policy.

5. License

FidelityPoints grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Service strictly in accordance with the terms of this Agreement.

6. Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Service or make the platform available to any third party.
  • Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Service.
  • Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of FidelityPoints or its affiliates, partners, suppliers or the licensors of the Service.

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of PASCOVICI SERBAN-CONSTANTIN II and its licensors. The Service is protected by copyright, trademark, and other laws of both Romania and foreign countries.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

You may terminate your account at any time by using the "Delete Account" feature within the application.

9. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Under no circumstances shall FidelityPoints or its affiliates be liable for any direct, indirect, special, incidental or consequential damages, including, but not limited to, loss of data or profit, arising out of the use, or the inability to use, the materials on this site, even if we or an authorized representative has been advised of the possibility of such damages. If your use of materials from this site results in the need for servicing, repair or correction of equipment or data, you assume any costs thereof.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect.
